New data protection law in the context of digitalization: What do Swiss companies need to consider now?

Switzerland is getting a new law for better protection of personal data (nDSG). Companies will have to comply with the new rules in future and should adapt their existing policies and data protection declarations by the time it comes into force on September 1, 2023.

 

     

    In the 2020 fall session, Congress passed the new Federal Data Protection Act (revDSG). It improves the processing of personal data and grants Swiss citizens new rights. This significant change in the law entails several obligations for Swiss companies.

     

    The completely revised Data Protection Act (DSG) and the implementing provisions for the new Data Protection Ordinance (DSV) and the new Data Protection Certification Ordinance (VDSZ) will come into force on September 1, 2023.

     

    • If a company does not comply with the regulations, it risks high fines and reputational damage.
    • Be compliant, build trust with your customers and demonstrate your commitment to data protection.
    • They also ensure that personal data is handled responsibly and securely and that individuals control its use.
    • Compliance with EU requirements: The new DPA ensures that data can continue to flow freely with the EU and that Swiss companies remain competitive.

     

    • Prioritize privacy.
    • Appoint a Data Protection Officer (DPO) to monitor compliance with the Swiss Data Protection Act and other data protection laws and provide advice and guidance on data protection
    • Keep records of all processing activities (process activity logs).
    • Establish internal practices and procedures for storing, using, transferring and deleting data in accordance with the law.
    • Define processes for information rights, handle data breaches and assess the impact on data protection.
    • Train all employees on the new DSG and data protection topics.
    • Carry out a weak point analysis:
      • > Analyze your current data protection situation.
      • > Identify potential data protection weaknesses and risks.
      • > Create a roadmap to take action and reduce risks.
